This learning module discusses what you need to know about Harassment and anti-harassment in the workplace.

Harassment is a form of discrimination and is a serious offence in many countries. This behaviour can take various forms such as physical, verbal, or written, and be directed at people on the basis of their race, ethnicity, national origin, religion, sexual orientation, gender identity, or other characteristics. Acts of harassment can range from threatening and intimidating language or actions, to offensive jokes or actions that create a hostile atmosphere. As highlighted by the #metoo and #TimesUp anti-harassment campaigns, workplace harassment can lead to significant repercussions for both the victim and the perpetrator.

Harassment can also include more subtle forms of discrimination, such as:

  • Excluding someone from work-related activities or making offensive or derogatory remarks about someone’s appearance or background.
  • Any behaviour that creates a hostile or intimidating work environment, regardless of whether it is based on a person’s gender, race, age, or any other protected characteristic.

Many countries have national, or local laws and regulations that prohibit anti-harassment which apply to different settings such as workplaces, schools, and public spaces. Victims of harassment can file a complaint with their employer or school, or with a government agency and may also be able to seek legal remedies through the courts.

Employers have a responsibility to prevent and address harassment in the workplace, and may face legal consequences if they fail to do so. It is important for employers to provide regular mandatory, annual training to all employees on what constitutes harassment and how to prevent it.

One of the measures employers can take is to put in place anti-harassment policies to protect employees from being subjected to harassment on the basis of their race, gender, age, sexual orientation, or other protected characteristics.

Key Themes

There are several key themes you need to know about harassment and anti-harassment in the workplace:

  1. Definition of harassment: It is important to clearly define what constitutes harassment in the workplace, including various forms of harassment such as sexual harassment, bullying, and discrimination.
  2. Prevention and policies: Organizations should have clear policies and procedures in place to prevent and address harassment, including training for employees and managers on what constitutes harassment, how to report it, and how to respond appropriately.
  3. Reporting and investigation: It is crucial to have a clear process for reporting harassment, and for investigating and addressing complaints promptly and fairly.
  4. Accountability: Employers should hold individuals accountable for their behaviour and take appropriate disciplinary action when harassment occurs.
  5. Support and resources: Employers should provide resources and support for victims of harassment, including counseling, legal assistance, and time off if necessary.
  6. Culture and communication: Organizations should promote a culture of respect and inclusion, and communicate regularly with employees about the importance of preventing harassment and the steps being taken to address it.
