This learning module discusses Competition, Anti-Competitive, Restrictive and Unfair business practices.
Competition is the act of engaging with others in order to determine who is better at accomplishing a task, an activity, a project or achieving better results.
Competition is essential and healthy, and in a business context, it can level the playing field and create a fair market. This can promote innovation, improve products and services, and give consumers more choices.
Not all organisations and businesses follow these simple civilised dictums; in a race to be successful, some organisations use anti-competitive practices or behaviour, actions or strategies also known as anti-trust to reduce or eliminate competition in a market. These practices can include things like price fixing, exclusive dealing agreements, and predatory pricing, all of which can distort competition and prevent other firms from entering or competing in a market.
As we will learn in this course, these practices are not only against the law, but can also harm those very organisations and businesses that use anti-competitive practices.
The term ‘anti-competitive practices’ is more of a general term. In this course, we will unpack the term but at this early juncture it is important to know that the two main categories of anti-competitive behaviour and practices are Restrictive Business Practice and Unfair Business Practice.

Key Themes

Here are some key themes and definitions related to competition, anti-competitive behaviour, restrictive practices, and unfair business practices:

  • Benefits consumers by giving them more choices and lower prices.

Anti-Competitive Behavior:

Restrictive Practices:

  • Actions that limit the freedom of businesses to compete.
  • Can be legal, but may be subject to regulation or oversight.
  • Examples include exclusive dealing, tying arrangements, and resale price maintenance.

Unfair Business Practices:

  • Actions that are deceptive, fraudulent, or unethical.
  • Can harm consumers, other businesses, or the public.
  • Examples include false advertising, bait and switch, and pyramid schemes.

It’s important for businesses to understand and comply with laws and regulations related to competition, anti-competitive behaviour, restrictive practices, and unfair business practices to ensure a level playing field for all businesses and protect consumers.
